Acceptance of Terms

By checking the box and completing checkout on diamonddebrissolutions.com (the “Site”), the individual or entity placing the order (“Customer”) agrees to these Terms and Conditions (“Terms”) with Diamond Debris Solutions (“Company,” “we,” “us,” or “our”). If you do not agree, do not place an order.

Service Area and Offerings

We provide residential and commercial dumpster rentals in the Tampa Bay, Florida area. Available sizes include 10, 15, 20, and 30 cubic yards, plus a lowboy option for heavy materials (concrete, dirt, rock, sod, bricks). See current offerings and specs on our Site’s rentals pages.

Rental Period, Extensions, and Daily Fees

• Included Days: Unless otherwise stated at checkout or in the order confirmation, rentals include 3 days.
• Daily Extensions: Extension fees apply after the included days. Example: the 10-yard shows $19.99 per additional day; other sizes may vary. The applicable daily fee is the one shown at checkout for your selected size.

Pricing, Weight Allowances, and Overage

• Posted Rates: Pricing is displayed on the Site and/or at checkout for each size. If a range is shown on a page (e.g., $299/$375), the price at checkout controls for your order.
• Included Weight: Weight allowances are size-specific and shown at checkout. Example: the 10-yard currently includes 1,000 lbs.
• Overage: If your dumpster exceeds the included weight, overage is billed at the posted rate shown at checkout (the 10-yard page currently lists $80 per ton). Overage is based on disposal facility scales.

Payment Methods and Authorization

• Electronic Payments Only: We accept Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, PayPal, PayPal Credit, Venmo, and Cash App. We do not accept cash or checks.
• Authorization: By ordering, Customer authorizes Company to charge the payment method on file for base rental, taxes, specialty item fees, overage, extension days, dry-run/inaccessible pickup fees, contamination fees, and other charges under these Terms.

Delivery, Access, and Site Conditions

• Adult Presence: An adult must be present at delivery (Company policy).
• Access: Customer must provide safe, unobstructed access and adequate clearance for delivery and pickup.
• Placement: Customer is responsible for selecting a placement area capable of bearing the dumpster and truck weight. We are not responsible for damage to driveways, pavement, curbs, lawns/landscaping, septic systems, underground utilities, or other property surfaces from delivery, placement, or pickup.

Use of the Dumpster

• Load Level: Material must not exceed the top rim and must allow the tarp to fully close. Doors must be closed and secured before pickup. Overfilled or unsafe loads may be adjusted or refused at Customer’s expense.
• No Moving the Dumpster: Customer must not move the dumpster. If repositioning is needed, contact us; service fees may apply.
• Size-Specific Rules: The heavy material lowboy (e.g., “Concrete, Dirt and Sod Dumpster”) is strictly for concrete, dirt, rock, sod, bricks, and similar dense aggregates. Contamination may incur additional charges.

Materials Allowed and Prohibited

• Allowed (examples): Common household items; furniture/appliances (without Freon); yard waste; construction debris (drywall, lumber, shingles, siding, flooring); general trash; metal scraps; boxes/packaging.
• Prohibited (examples): Hazardous waste, flammable liquids, fuels, paints/chemicals, tires, batteries, asbestos-containing materials, medical waste, and any item restricted by law or disposal facility rules. If unsure, contact us before disposal.

Missed or Inaccessible Pickup

If pickup is unsafe or inaccessible (blocked access, overfilled/unsafe load, unsecured doors, etc.), we may assess a dry-run fee and/or additional daily rental charges until conditions are corrected and pickup is completed.

Permits and Compliance

Customer is responsible for obtaining any required permits (e.g., right-of-way/street placement), complying with local ordinances and HOA rules, and observing disposal facility regulations.

Responsibility for Contents and Indemnification

• Responsibility: Customer is responsible for the contents of the dumpster until accepted by the disposal facility.
• Indemnification: Customer agrees to indemnify and hold harmless Company and its personnel from claims, damages, fines, penalties, cleanup/remediation costs, and reasonable attorneys’ fees arising from Customer’s breach of these Terms, disposal of prohibited materials, or violation of laws or facility rules.

Disclaimers and Limitation of Liability

• “As Is”: Except as expressly stated, services are provided “as is” and “as available.”
• Property Damage Limitation: We are not responsible for cosmetic or structural damage to surfaces/areas where Customer requests placement or to approaches used by delivery trucks.
• Liability Cap: To the maximum extent permitted by law, our total liability is limited to the amounts paid by Customer for the rental giving rise to the claim.

Changes, Cancellations, and Refunds

Changes to size, timing, or services are subject to availability and may affect pricing. Cancellations and refunds follow the terms shown at checkout or in your order confirmation; certain fees may be non-refundable once services are dispatched or delivered.

Termination and Retrieval

We may suspend/terminate services and retrieve the dumpster if Customer breaches these Terms, places prohibited materials, or creates unsafe conditions. Customer remains responsible for accrued charges and retrieval-related costs.

Electronic Communications and Notices

We may send order updates, invoices, and notices via email, SMS, website messaging, or other reasonable electronic methods. By ordering, Customer consents to electronic communications.

SMS/Text Messaging Disclosures and Consent

• Program Description: Diamond Debris Solutions sends text message updates and responses to consumer customers about pricing and products offered at https://diamonddebrissolutions.com/.
• Use Cases: We use text messaging to confirm orders, coordinate delivery and pickup, provide service updates, and respond to inquiries.
• Consent: By providing your mobile number and opting in (e.g., checking a box at checkout or texting to initiate conversation), you consent to receive texts from us for the purposes you selected.
• Frequency: Message frequency varies by interaction.
• Message and Data Rates: Message and data rates may apply from your carrier.
• Opt-Out/Help: Reply STOP to opt out at any time. Reply HELP for help. We may send a confirmation text of your opt-out request.
• Third-Party Sharing for SMS: Mobile phone information is stored securely and will not be shared with third parties or affiliates for marketing or promotional purposes. We may share information with service providers solely to deliver and support the messaging service.
• Carrier Disclaimer: Carriers are not liable for delayed or undelivered messages.
• Record of Consent: We maintain records of consent as required by applicable law.

Governing Law and Venue

These Terms are governed by Florida law. Venue lies in the state or federal courts located in or serving Hillsborough County, Florida.

Severability, Waiver, and Entire Agreement

If any provision is unenforceable, it will be modified to the minimum extent necessary, and the remainder remains in effect. No waiver is effective unless in writing and no waiver of one breach is a waiver of another. These Terms, together with checkout and order confirmation details, constitute the entire agreement and control over conflicting marketing or website content unless the order confirmation expressly states otherwise.

Acknowledgment of Electronic Acceptance

By checking the box and completing checkout, Customer acknowledges and agrees that these Terms are binding upon electronic acceptance.
